1. Information We Collect

1.1 Information You Provide Directly

When you create an account and use Togetherly, you provide:

Account Information:

  • Email address
  • Password (encrypted and never stored in plain text)
  • Names of both people in the couple

Content You Upload:

  • Photos and images
  • Date descriptions and notes
  • AI chat conversations with Spark
  • Any other content you choose to share

Payment Information:

  • Processed by Stripe (our payment processor)
  • We do NOT store your credit card details on our servers
  • Stripe handles all payment data according to PCI-DSS standards

1.2 Information Collected Automatically

Usage Data:

  • Pages you visit within the Service
  • Features you use
  • Date and time of your visits
  • Device information (browser type, operating system)

Location Data:

  • We may collect approximate location data to provide relevant date suggestions
  • Location data is used only for generating suggestions and is not stored permanently
  • You can disable location access through your device settings

Cookies and Similar Technologies:

  • We use only essential cookies required for authentication and Service functionality
  • No advertising or tracking cookies
  • No third-party tracking pixels

1.3 Information We DO NOT Collect

We do NOT collect:

  • Phone numbers
  • Social Security numbers
  • Financial information (handled by Stripe)
  • Precise GPS coordinates
  • Data from other apps or services you use

2. How We Use Your Information

We use your information to:

  • Create and manage your account
  • Store your photos and memories securely
  • Generate daily date suggestions using AI
  • Provide Spark AI assistant for personalized planning
  • Process your yearbook orders
  • Send transactional emails (password resets, payment confirmations)

Improve the Service:

  • Analyze usage patterns to improve features (anonymized data only)
  • Debug technical issues
  • Develop new features

Communicate with You:

  • Send important Service updates
  • Respond to your inquiries and support requests
  • Send subscription renewal reminders

Legal Compliance:

  • Comply with legal obligations
  • Enforce our Terms of Service
  • Protect against fraud and abuse

2.1 What We DO NOT Do with Your Data

We do NOT:

  • Sell your personal information to third parties
  • Use your photos for marketing purposes
  • Share your photos publicly without your permission
  • Send your data to AI model training (your conversations stay private)
  • Review or analyze your private conversations
  • Share your data with advertisers
  • Send marketing emails (unless you opt in)

3. How We Share Your Information

3.1 Service Providers

We share limited information with trusted third-party service providers who help us operate the Service:

Supabase (Database and Authentication):

  • Stores your account data and photos
  • Provides secure authentication
  • Located in the United States
  • Subject to their privacy policy

Stripe (Payment Processing):

  • Processes subscription payments
  • Stores payment methods securely
  • We do NOT see your full credit card details
  • Subject to their privacy policy

Google Gemini API (AI Features):

  • Generates date suggestions and Spark AI responses
  • Receives only the specific content needed for each request
  • Your data is NOT used to train Google's AI models
  • Subject to Google's API terms

Resend (Email Communications):

  • Sends transactional emails (password resets, receipts)
  • Subject to their privacy policy

Third-Party Printing Services (Yearbooks):

  • Receives photos and layout only when you purchase a yearbook
  • Used solely for printing and shipping your order
  • Does not retain your data after fulfillment

All service providers are contractually obligated to protect your data and use it only for providing services to us.

3.2 Legal Requirements

We may disclose your information if required to do so by law or in response to:

  • Valid legal requests (subpoenas, court orders)
  • Law enforcement investigations
  • Protection of our rights, property, or safety
  • Protection of users or the public

3.3 Business Transfers

If Dapper Chimp, LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred. We will notify you via email and/or prominent notice on our Service before your information is transferred and becomes subject to a different privacy policy.

We take data security seriously and implement appropriate technical and organizational measures:

  • Secure cloud infrastructure (Supabase with built-in security features)

Important Note:

While we strive to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

5. Your Data Rights and Choices

5.1 Access and Update

You can access and update your information at any time through your account settings.

5.2 Export Your Data

You have the right to export all your data, including:

  • Photos and content
  • Account information
  • AI chat history

To request a data export, contact us at colton@dapperchimp.com or use the export feature in your account settings.

5.3 Delete Your Data

You have the right to permanently delete your account and all associated data.

What happens when you delete your account:

  • All photos and content are permanently deleted
  • All AI chat conversations are permanently deleted
  • All account information is permanently deleted
  • Active subscriptions are cancelled (no refund)
  • This action is irreversible

What is NOT retained:

  • We do NOT retain any of your personal data after deletion
  • We do NOT keep backups of deleted accounts
  • Your data is completely removed from our systems

5.4 Manage Communication Preferences

You can control email communications through your account settings. Note that you cannot opt out of essential transactional emails (password resets, payment receipts).

5.5 Manage Location Access

You can disable location access at any time through your device settings. This may limit the relevance of date suggestions.

5.6 Cookie Preferences

Since we only use essential cookies for authentication, there are no optional cookie preferences to manage.

6. Data Retention

While Your Account is Active:

  • We retain your data for as long as your account is active
  • Photos and content are stored indefinitely until you delete them

After Subscription Cancellation:

  • Your data remains accessible until you delete your account
  • Free tier users can continue using basic features

After Account Deletion:

  • All data is permanently deleted within 30 days
  • No backups are retained

Legal Requirements:

  • We may retain certain information if required by law (e.g., tax records)
  • Anonymized usage data may be retained for analytics

7. Children's Privacy

Togetherly is intended for users 18 years of age and older. We do not knowingly collect information from anyone under 18.

If we discover that we have collected personal information from someone under 18, we will delete that information immediately.

8. International Users

Togetherly is currently available only to users in the United States. All data is stored on servers located in the United States.

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA):

NOT sold: We do not sell personal information

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will:

  • Update the "Last Updated" date at the top
  • Notify you via email if changes are material
  • Post a notice within the Service

Your continued use of Togetherly after changes become effective constitutes acceptance of the updated Privacy Policy.

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies.

12. AI and Automated Decision-Making

AI-Generated Content:

  • We use Google Gemini API to generate date suggestions and Spark AI responses
  • These are recommendations only and do not make automated decisions about you
  • You maintain full control over what suggestions you follow
  • Your conversations are private and not used for AI training

No Profiling:

  • We do not use automated decision-making or profiling that produces legal or similarly significant effects
